The Privacy Policy

The Privacy Policy governs how we process
and safeguard your personal information when
you use the website of the Foundation.

1. General Requirements.
You can learn about the privacy policy here.

1. 1 When you use our website, you give us personal information such your email, first name, and last name. We keep such information safe and secure as best we can.

1.2 In this Privacy Policy (further – “Policy”), we explain why and how we collect and use information about you as a Donor (further – “User”), including personal data as defined by the legislation of the Republic of Belarus (further – “Personal Data “, “Your data”, “Data about you”).

1.3 You will also find information in the Policy on your rights as a subject of Personal Data and how to exercise them.

1.4 This policy applies to any Personal Data processed on our website fundmiasin.by, whether or not automated techniques are used. 1.5. The policy was influenced by the Law of the Republic of Belarus No. 99- “On the Protection of Personal Data” dated 07.05.2021 (further as the “Law on Personal Data”) and other regulating legal acts of the Republic of Belarus in the field of information protection.

1.6 The Policy does not apply to the processing of Personal Data in the course of employment.

1.7 The terminology in the Policy have the meanings specified in the User Agreement and the Law on Personal Data.

2. Information on the Operator.

2.1. The Personal Data Operator is the International Charitable Foundation “Miasin” (further the Foundation), which was registered by the Ministry of Justice of the Republic of Belarus on November 18, 2021.

2.2. The Foundation is referred to as the “Operator”, “we”, “us/us” or “our” in this Policy.

2.3. If you have any questions about this Policy, how we use your data, or how we comply with applicable laws, please contact our Data Protection Officer at fundmiasinby@gmail.com.

3. Personal data processing principles
Here you will learn about the main rules that we follow when working with your data

3.1. We are guided by the following principles while processing your data:

3.1.1. legality, fairness, and openness (the collecting and processing of personal data is done only if there are legal grounds for it and in such a way that you understand why and how we use your data);

3.1.2. preservation of citizens’ human rights and liberties, privacy, personal and family secrets, and (or) other rights, liberties, and legitimate interests;

3.1.3. data minimization (we gather only the Personal Data that is absolutely essential, the content and volume of which must correspond to the original processing goals);

3.1.4. processing restriction (Personal data is gathered for specific objectives and cannot be used for other purposes; the term of storage of data about you is likewise restricted to the original purpose);

3.1.5. accuracy (personal data must be corrected, clarified, and updated on a regular basis to ensure their dependability);

3.1.6. integrity and confidentiality (we take organizational, legal, and technical measures to safeguard your personal information).

4. Personal data processing list
Here you may learn about the information we collect about you.

4.1. We may collect the following categories of Data about you when you use our site:

4.1. 1. information provided by you when filling out an electronic form on the website of the Foundation for donating, such as the name and surname of the Donor, e-mail, and the purpose of the donation chosen by you. This information is processed by us to identify the Donor, make a donation by the Payment Service, and send a notification confirming the payment;

4.1. 2. information you provide while filling out the feedback form, such as your name, phone number, and any other information you provide. We use this information to respond to your message.

4.1. 3. Identifiers: HTTP headers, IP address, cookies required for site functioning, web beacons/pixel tags, browser ID data, hardware and software information, and wi-fi network data. Such information is gathered automatically to maintain the functioning of the site.

4.2. We do not store credit card information. If you wish, you can choose the option to “remember” the bank card details to facilitate the donation process in the future. The WEBPAY payment system securely (using encryption methods) and confidentially stores the data of the Donor’s bank card. When connecting the Subscription, the Foundation receives from the Payment Service and stores the token of the payment instrument, which is necessary for authorizing a bank card and making a donation. The payment instrument token does not contain confidential information (it is a non-confidential equivalent), it is a link that allows the Payment System to identify the payment instrument.

You can delete information about bank cards previously used to donate at any time. This will lead to the fact that the Payment system will delete the information, and in the future, to donate, the bank card data will need to be entered again.

5. Legal Basis and Purposes of Personal Data Processing
Here you will learn why and on what grounds we may collect data about you.

5.1. We are not permitted to use your data unless we have legal grounds. As a result, we only process Personal Data only if:

5.1.1. the processing is necessary to fulfill the Operator’s contractual obligations to you;

5.1.2. processing is necessary to fulfill the obligations imposed on the Operator by law;

5.1.3. the processing of Personal data posted in public sources, including data to which you have provided access to an unlimited number of persons by distributing them;

5.1.4. data is processed for scientific or other research purposes, subject to mandatory depersonalization of Personal data.

5.2. In other cases, we will ask you for your consent to the processing of Personal Data (in electronic form). If we refuse to consent to the processing of Personal Data, we may not be able to perform the actions you request or other operations described below.

5.3. We use Data about you for certain purposes and only process Personal Data that is relevant to the achievement of such purposes.

5.4. We process Personal Data for the following purposes:

5.4.1. donating the terms described in the User Agreement. For this purpose, the Operator may process Data about you without having to ask for consent to the processing of Personal Data;

5.4.2. reporting generation. It is carried out without the need to obtain your consent, as it is a requirement of the legislation of the Republic of Belarus.

5.4.3. to contact you in response to your message sent to us via the feedback form. We will ask you for your consent to process Personal Data for these purposes;

5.4.4 sending educational and promotional messages and resources to the Donor’s email. If you agree, it will be carried out. If you do not wish to receive such information, then you can inform us at any time or independently unsubscribe from such communications using the link sent in the electronic message;

5.4.5 for analytical and statistical research. We use non-personalized information about you to analyze and improve the site. This does not require your consent.

6. Ensuring the security of Personal Information

6.1. We process your data in a manner that ensures their appropriate security, including protection against unauthorized or accidental access to them, destruction, alteration, blocking, copying, sharing, distribution, other unauthorized or unlawful processing, accidental loss, destruction or damage to personal data and from other illegal actions against them.

6.2. To protect Personal Data during its processing, we have implemented a set of legal, organizational, and technical data. These measures were implemented taking into account the applicable legal requirements, the state of the art, the cost of their implementation, and the risks associated with the processing and nature of Personal Data.

6.3. Legal measures:

6.3.1. we have clear local regulations in the field of processing and protecting personal data. Our employees are familiar with such acts and follow their requirements in their work;

6.3.2. we include provisions on the protection of personal data in labor agreements and/or job descriptions of the Operator’s employees who carry out activities related to the processing of personal data, in particular, have access to Personal data as part of their job duties;

6.3.3. we include in agreements with partners whose activities are in any way related to the use of Personal Data, conditions aimed at ensuring the protection of such information;

6.3.4. where necessary, we enter into separate confidentiality agreements with both employees and third parties.

6.4. Organizational measures:

6.4.1. periodically we monitor and evaluate the effectiveness of the measures taken to protect personal data;

6.4.2. we keep records of our personal data processing operations;

6.4.3. we have appointed a person responsible for the protection of personal data.

6.5. Technical measures:

6.5.1 we use information security software;

6.5.2. we have implemented mechanisms for detecting the facts of unauthorized access to personal data and taking measures to respond;

6.5.3. we restrict access to personal data.

7. Transfer of Personal Data
Here you will find out with whom we transfer your data.

7.1. To achieve the purposes specified in section 5 of this Policy, we may transfer your data to the extent strictly limited by the purposes of the processing, to the following persons (including authorized persons):

7.1.2. Armenian branch of the Foundation;

7.1.3. third parties to whom we are obliged to provide information by the legislation of the Republic of Belarus (for example, at the request of state authorities).

7.2. We guarantee that all authorized persons are bound by contractual obligations to protect Personal Data received from the Fund based on contracts concluded by Art. 7 of the Law on Personal Data.

7.3. We guarantee that there will be no disclosure of Users’ personal data in violation of this Policy.

8. Procedure and conditions for storing Personal data

8.1. We process your data, including storage, on the territory of the Republic of Belarus. Your data may be transferred to the territory of Armenia. Armenia is a party to the Council of Europe Convention for the Protection of Individuals’ automated processing of personal data adopted in Strasbourg on 28 January 1981. This means that Armenia provides an adequate level of protection for your rights as a subject of Personal Data and is a safe country to transfer Personal Data. As a result, if necessary, we may transfer your data to the Armenian branch of the Foundation without obtaining additional consent for the purposes specified in section 5 of the Policy.

8.2 We keep your data for as long as necessary to achieve the purposes for which they were collected, as well as to comply with applicable legal requirements and (or) enforce the User Agreement.

8.3 As a result, to provide informational and advertising messages and materials, the period of storage of Personal Data is limited by the validity of consent to the processing of personal data and (or) consent to advertising mailings. The history of donations made by the Donor, the information provided by him through the feedback form, is stored for 5 years.

8.4 If the law (for example, due to the requirements of tax laws) provides for a different period for the storage of documents containing Personal Data, then we will store the data for the period established by law. In this case, in any case, we will block your data so that no actions concerning you can be taken by the Operator. We delete Personal Data within 2 weeks from the expiration date.

9. Rights of data subjects

You have the right to require us to amend your personal data in cases where they are incomplete, inaccurate, or no longer relevant. Within 15 days of receiving your request, we will make appropriate changes to your personal information.
4. The right to terminate the processing of personal data or their deletion You have the right to demand that we stop processing your personal data free of charge, including their deletion in the absence (loss) of grounds for processing such data. Within 15 days from the date of receipt of the request, we will stop processing your personal data, unless we, as the Operator, have the right to continue processing personal data if there are grounds established by law.
5. The right to withdraw consent to the processing of personal data If your consent is the legal basis for our processing of your personal data, you can withdraw it at any time. You can withdraw consent without giving reasons. This will not affect the lawfulness of the basis for data processing until your consent is withdrawn. Within 15 days from the date of receipt of the request, we will stop processing your personal data, delete it and notify you about it. The exception is cases when we have the right to continue processing personal data if there are grounds established by the legislation of the Republic of Belarus.
6. The right to appeal our actions If you believe that our actions regarding the processing of your personal data violate the law or your rights, you can file a complaint with the competent authority The complaint is submitted to the National Center for the Protection of Personal Data of the Republic of Belarus in electronic or written form. The term for consideration of the complaint is 1 month from the day following the day of its registration. The appeal procedure is established by the Regulations of the National Center for the Protection of Personal Data

 

9.2 The rights specified in paragraphs No. 1-4 above can be exercised by you by sending us a request in writing or electronic form indicating: your full name; the essence of requirements; personal signature or electronic digital signature; date of birth (if such information was processed by the Operator).

9.3 The request can be sent to:

9.4 We do not consider applications of personal data subjects sent by other means (telephone, fax, etc.).

9.5. The right to withdraw consent to the processing of personal data (clause No. 5) can be exercised by you either by sending a request in the manner specified above, or in the same form in which the consent to the processing of personal data was given.

9.6. For assistance in exercising your rights and obtaining any additional information, you can contact the person responsible for exercising internal control over the processing of personal data in the Foundation by sending a message to the email.

10. Cookies

10.1. Small text files known as “cookies” are used to assess and optimize the site’s functionality.

10.2 We use mandatory cookies to enable you to move around the site and use its basic functions. We also use performance cookies, which collect information about the use of the website by visitors in an anonymous and aggregated form. They are used to analyze and improve the operation of the site.

10.3 The cookies we gather do not allow us to identify you. We do not collect functional cookies that allow you to personalize or customize the site based on your behavior.

11. Policy Update

11.1 This Policy is subject to modification.

We may modify this Policy from time to time for a variety of reasons, including legal and regulatory changes, changes in industry rules, and technological advances.
